ONLINE STORE DELIVERY TERMS

General

The seller in the online store is Päijän Boats Oy (the “Seller”). The prices displayed in the online store include the Finnish value added tax applicable at the time. We reserve the right to change prices in the event of human error. Placing an order in the online store requires acceptance of these delivery terms. If you wish to review the delivery terms before placing an order, they are available via the link at the bottom of the online store page. The delivery terms must be read and accepted separately in connection with each order because the terms may be amended. Several payment methods are available in the online store. More detailed information about the payment methods is available under “Payment methods” at the bottom of the online store page.

The Seller currently delivers products ordered from the online store to Finland and Sweden. Boats are not delivered to Åland or outside mainland Finland. The customer may provide a delivery address and recipient other than their own. The customer is responsible for ensuring that the information provided in the order and customer details is correct.

Placing an order

Registration is not required to place an order, although it is recommended. For each order, the customer must provide accurate contact details in the designated fields. Customer information stored in the online store is confidential. The Seller undertakes not to disclose customer information to third parties.

Please also read the Seller’s online store privacy notice, available under “Privacy” at the bottom of the online store.

Product categories are available in the Products menu at the top of the page. The menu can be used to browse spare parts and accessories. Once you have found the product you want, move the cursor over the image to select the quantity and add the product to the shopping cart using the “Add to cart” button.

You can view the contents of your shopping cart at any time by clicking “Shopping cart” in the upper-right corner of the page. In the shopping cart, you can also change the products and quantities selected. The available delivery methods can be selected below the address details in the shopping cart. If the products cannot be delivered using the method selected by the customer, for example due to the size of the shipment, the Seller may change the delivery method. Where necessary, the Seller reserves the right to replace a product with an equivalent product, for example a newer version of the product.

Once you have added all the products you wish to purchase to the shopping cart, check that the order details are correct, including the contents of the cart, delivery address and delivery method, and read the delivery terms. An order cannot be placed without accepting the delivery terms. Once the information is correct and the delivery terms have been accepted, you can select a payment method. After payment, you will receive an order confirmation by email.

On the customer account pages, you can view and, where necessary, update your information. You can also change your password under “Personal details”.

Right to refuse or cancel an order

Occasionally, a customer may be able to order a product that is unavailable, for example because of an incorrect stock status, even though the online store indicates that the product is in stock. In such a case, the system may send an order confirmation despite the product being unavailable. The Seller will notify the customer by email at the address provided and offer a replacement product where one is available. Where necessary, both the Seller and the customer have the right to cancel the transaction.

The Seller reserves the right to cancel an order in the event of an obvious and material pricing error. This refers to a pricing error where the displayed price differs so significantly and clearly from the customary price of the product that an average consumer could reasonably be expected to understand that it is incorrect. Examples include a product price of EUR 0.00, no price being displayed at all, or a price shown for a product worth hundreds of euros that is so low that it would generally be understood to be erroneous.

The Seller reserves the right not to deliver a product if the price or availability information was incorrect due to a technical malfunction, human error, typographical error or other error in expression, or if the stock balance was incorrect when the customer placed the order and the product is, for example, sold out.

The shopping cart does not reserve products. Product prices and availability may therefore change while a product remains in the shopping cart.

Binding nature of the order

Communication between the parties takes place primarily by email. A binding sales contract is formed when the online store has sent an order confirmation by email. Before delivery, the customer may cancel the entire order or part of it by email or by using the form on the online store’s “Contact us” page. Delivery is deemed to have taken place when any part of the order has been delivered to the consumer or when the consumer has received notification that the order is available for collection. The Seller has the right to cancel an order if the online store displayed a clearly incorrect price for the product.

Delivery

Delivery charges vary according to the total value and contents of the order and the delivery method selected. The total delivery charge is shown in the shopping cart before payment.

Delivery charges for Aerot oars are determined by delivery zone within Finland. A fixed delivery charge applies to deliveries to Sweden.

A delivery charge of EUR 150 is charged for a boat-only order. The boat may be collected from a selected Päijän dealer if dealer delivery is available in the relevant area. Dealer delivery is available on a limited basis and is not available to Oulu, Kainuu or Lapland. A boat may also be collected free of charge from the Päijän Boats Oy premises in Hollola. Boat-only or accessory orders cannot be delivered to a home address. If there is no participating Päijän dealer near your home or holiday home, please contact Päijän Boats Oy customer service.

Delivery charges for boat packages are determined by delivery area as follows:

  • The provinces of Southern Finland, Western Finland and Eastern Finland: EUR 250
  • The Province of Oulu: EUR 350
  • Lapland: EUR 450

Boat packages are delivered only within mainland Finland, excluding Åland and the Turku archipelago. Deliveries are primarily carried out by Kuljetus J. Heinonen Oy.

For collection orders, the price is determined according to the shopping cart without freight charges.

For deliveries of larger quantities, please contact customer service.

NOTE: Please also check your email spam folder in case the arrival notification has been classified as spam. This helps avoid an unnecessary return and any additional return or delivery charges.

If the products fit in a standard envelope, the order may be sent as an untracked letter.

Please note that failure to collect or accept a parcel does not constitute a return. If the customer does not collect the parcel by the deadline stated in the arrival notification, the shipment will be returned to the Seller. The Seller is entitled to charge a handling fee of EUR 19.90 for an uncollected parcel. This amount will be deducted from the total amount of the customer’s order. If the order total was less than the handling fee, no refund will be payable. If you wish to return your order, you must first collect or accept the shipment. See “Returns” below for detailed instructions.

Delivery time

  • If the product is in stock, the estimated processing time is 3–5 business days from receipt of the order. The carrier’s transit time is added to this.
  • The Seller is not responsible for delays in made-to-order products caused by delays or cancellations by importers or suppliers.
  • The online store is not responsible for delivery delays caused by circumstances beyond its control.
  • If an order contains several products and some become available later than estimated, the entire order will be dispatched together once all products are ready for shipment.
  • The Seller delivers products ordered from the online store only to Finland and Sweden, except for boats and boat packages, which are delivered only within mainland Finland.

Returns

  • A consumer customer has the right to return an entire order or part of it within 14 days of receiving the shipment, excluding the date of receipt. Returned products must be unused, and both the product and any retail packaging supplied with it must be in resaleable condition. All product labels, stickers and instructions must be included in their original form. The customer pays the return postage and the original delivery charges. The Seller does not accept cash-on-delivery returns or returns subject to payment on receipt.
  • The right of return does not apply to special-order or MADE-TO-ORDER PRODUCTS. A special-order product is a product that Päijän Boats does not normally stock and that the Seller orders from a supplier or manufacturer based on the customer’s order.
  • The online store does not offer exchanges. You may return an unopened and unused product, in which case the online store will refund the product. You may then place a new order if you wish.
  • Before returning a product, the customer must notify the online store by email at info@paijanboats.fi. The return notice must state the order number, the product code and quantity of each product being returned, and the customer’s contact details, including name, address and telephone number. Delivery charges paid when placing the order are not refunded.
  • A duly completed return form must always be included with the returned shipment.
  • Please note that failure to collect or accept a parcel does not constitute a return. If the customer does not collect the parcel by the deadline stated in the arrival notification, the shipment will be returned to the Seller. The Seller is entitled to charge a handling fee of EUR 19.90 for an uncollected parcel. This amount will be deducted from the total amount of the customer’s order. If the order total was less than the handling fee, no refund will be payable.

Shipments damaged in transit

  • Despite careful packaging, a parcel may occasionally be damaged during transport. The condition of the parcel must be inspected at the time of collection or receipt in the presence of the person handing it over. If both the parcel and the ordered product or products have been damaged in transit, immediately submit a damage report to the collection point or the person handing over the parcel and request written proof of the report. Then contact customer service at info@paijanboats.fi to arrange delivery of a replacement product.
  • If the outer packaging is undamaged and transport damage to the product is discovered only after opening the parcel, a claim must be submitted within seven days of receipt either at a Posti service point or via Posti’s website at https://www.posti.fi/en/customer-support/receiving/damaged-item. Then contact customer service at info@paijanboats.fi to arrange delivery of a replacement product.

Complaints

If the customer has received an incorrect product, or if a product is damaged or otherwise defective, the customer must notify the Seller within seven days of receiving the shipment by email at info@paijanboats.fi. In such a case, the shipment may be returned free of delivery charges in accordance with the instructions provided by the online store’s customer service.

Force majeure

The Seller is not liable if delivery of an order is prevented, hindered or delayed due to circumstances beyond the Seller’s control, including war, a natural disaster, an export or import ban, an authority decision, disruption of public transport or another similar circumstance that hinders or prevents the operation of the online store.

ONLINE STORE SALES TERMS

In our online store, we use the online store terms prepared by the Finnish Marine Industries Federation Finnboat. If these sales terms conflict with the online store delivery terms above, the delivery terms take precedence.

1. Definitions, scope and subject matter of the sale

“Customer” means private individuals, companies and other organisations that order goods through the Seller’s online store.

“Seller” means the merchant and, unless otherwise stated, also the operator of the online store.

“Website” means the Seller’s website on which the Seller operates the online store.

These online store terms are the terms recommended by the Finnish Marine Industries Federation Finnboat. They apply to online sales between the Seller and the Customer involving boats, engine accessories and spare parts, boating equipment and/or clothing where the Seller has stated that these terms apply. Provisions in these terms concerning a Customer’s right to return a product for reasons other than a warranty claim or defect do not apply to business customers.

2. Order

For every order, the Customer agrees to comply not only with these terms but also with any other contractual, usage and sales terms that the Seller has stated apply to the online store. The Customer should therefore carefully review the Seller’s other delivery terms available on the Website. If these terms conflict with the Seller’s other terms, the Seller’s other terms take precedence.

When placing an order, the Customer must provide their name, postal address, email address and telephone number. Business customers must also provide the company name and business ID. A Customer under 18 years of age must additionally provide the name and email address of the guardian who has given consent in the additional information field of the order.

After the order has been submitted, an order confirmation will be sent to the Customer. A binding sales contract is formed when the Seller has confirmed the order in writing.

3. Prices

Product prices include value added tax but exclude delivery charges. Delivery charges are added to the prices shown in the price list.

Before confirming the order, the Customer selects a delivery method from the options on the order form. Once the delivery method has been selected, the service displays the applicable delivery charge, which the Customer agrees to pay when confirming the order. All prices are stated in euros. Posti’s current price list is available at www.posti.fi/en/prices. Boat delivery charges are described in more detail under “Delivery” in the online store delivery terms in this document.

Products are sold at the price applicable when the order is placed. However, if an order is amended, the product price will be determined according to the price applicable at the time of the amendment.

Product information is displayed on the Seller’s Website. A product return resulting from an error in the product information is free of charge to the Customer and must be made within a reasonable time after the error was discovered or should have been discovered.

In the event of an obvious pricing error, the Seller may invoke the error, for example where the error was so apparent that the Customer should have noticed it.

4. Payment terms and payment

Information about the available payment methods and their terms is provided on the Seller’s online store pages and order form.

Payment service provider – Paytrail

The payment transfer and payment service provider is Paytrail Oyj (business ID 2122839-7), in cooperation with Finnish banks and credit institutions. Paytrail Oyj will appear as the recipient of the payment on the bank statement or card invoice and will forward the payment to the merchant. Paytrail Oyj is authorised as a payment institution. In the event of a complaint, customers are requested to contact the product supplier first.

Shop Pay

Shop Pay is an accelerated checkout service provided by Shopify. Customers using Shop Pay can save their email address, payment method, and shipping and billing information to speed up checkout in Shopify online stores. Payment is processed through Shopify Payments using the payment method selected by the customer in Shop Pay and available in the online store.

Klarna

The Klarna payment service is provided by Klarna Bank AB (publ). At checkout, the customer may select from the payment options currently offered by Klarna and available to that customer. The options may include paying immediately, paying later, paying in three instalments or financing. Availability of the payment options depends on factors including the order details and Klarna’s approval. Any invoice or credit is subject to the terms presented by Klarna at checkout before the order is confirmed.

When a product is collected against cash on delivery, it must be collected from the postal service by the deadline specified by Posti. Otherwise, the order will be deemed cancelled.

5. Delivery

Orders are delivered as separately agreed, either by post or by collection.

The Seller dispatches products in stock after a processing time of approximately 1–3 days. The normal carrier transit time is added to this. The Seller aims to notify the Customer if the processing time is longer than seven days. Delivery times are estimates. The Seller may not be able to deliver every product within the estimated time, as delivery times depend on product availability. The Seller reserves the right to limit sales of unusually large quantities.

6. Right of return

The Customer has the right to cancel an order at any stage, including after the order has been processed. If the Customer does not wish to collect an order from the postal service, it is recommended that the Customer nevertheless notify the merchant or the local post office. In such cases, the Seller has the right to charge the postal costs to the Customer.

Under Chapter 6 of the Finnish Consumer Protection Act, products have a 14-day right of return and exchange starting from collection of a postal parcel or collection order. Weekends and public holidays are included, but the collection date is excluded.

The right of return applies only to unused products in resaleable condition. During the return period, the Customer has the right to inspect and try the product in the same way as would be possible in a physical shop. The Customer may open the packaging to inspect and try the product without losing the right of withdrawal, but may not put the product into use. If the product is packaged in a sealed or similarly closed package, the package must remain unopened and the seal intact.

The right of return does not apply to hygiene products or products supplied to the Customer as special orders.

Returns by post in the circumstances described in Sections 7, 8 and 9 of these terms are free of charge to the Customer for domestic deliveries. The Seller will not reimburse other return methods unless separately agreed. The Customer pays the postage for returns from outside Finland unless otherwise agreed.

The purchase or collection date is the date on which the parcel was redeemed or collected from the postal service, or alternatively the date on the receipt. The Customer is responsible for proving the date on which the parcel was collected, for example using a postal receipt. Product returns must always be:

a) in the original packaging, securely packed and without unnecessary markings;
b) accompanied by a copy of the order confirmation;
c) accompanied by a completed warranty and return form available on the Seller’s Website;
d) dispatched no later than 14 days after collection of the goods; and
e) accompanied by the Customer’s bank account details.

The Seller will refund the payment no later than thirty (30) days after receiving the returned product.

7. Warranty

Some products have a product-specific warranty. If the Seller has offered a warranty for a product, the warranty period begins on the date stated in the order confirmation and continues for the stated warranty period. Replacement or repair under warranty does not extend the original warranty period.

The warranty requires the product or its component to be used in accordance with the manufacturer’s recommendations and instructions. The Seller may be released from warranty liability if the Seller demonstrates that the deterioration or breakage of the product was likely caused by an accident, improper use or another circumstance attributable to the Customer. If the manufacturer or repair service later determines, for example, that the product was damaged due to the Customer’s negligence, the Seller has the right to charge the resulting repair costs.

Under the Finnish Consumer Protection Act, the Customer must notify the warrantor of a defect within a reasonable time after discovering it or after it should have been discovered. Products sent for warranty service must always be:

a) in the original packaging and securely packed;
b) accompanied by a copy of the order confirmation;
c) accompanied by a completed warranty return form available on the Seller’s Website; and
d) limited to the defective product only, without other products or non-defective components.

The Seller may return products sent for warranty service without the required materials stated above at the Customer’s expense.

The Seller will complete warranty service within a reasonable time as defined in the Finnish Consumer Protection Act.

In the event of a warranty defect, the Customer must first contact the Seller unless the Seller has expressly instructed otherwise. If a party earlier in the distribution chain, rather than the Seller, provided the warranty, the Seller is not liable for the defect under that warranty where the Seller has separately stated this.

8. Buyer’s rights in the event of a defect

Any warranty or other commitment provided by the Seller does not restrict the buyer’s statutory right to invoke a defect in the product.

If a delivered product is defective, the Seller has the primary right to repair the defect, provided that this can be done within a reasonable time and without cost or material inconvenience to the Customer. If this is not possible, the Customer may demand a price reduction corresponding to the defect or a defect-free replacement product. If the defect is not minor in a consumer sale, the Customer may cancel the sale and claim compensation for direct loss.

If a defect becomes apparent within six (6) months of delivery, it is presumed to have existed at the time of delivery. This presumption does not apply if the Seller demonstrates that the defect arose only after delivery or if the presumption is incompatible with the nature of the defect or product.

The Customer must notify the Seller of the defect within a reasonable time after discovering it or after it should have been discovered. In a consumer sale, however, notice of a defect may always be given within two (2) months of the buyer discovering the defect. The buyer must act to prevent any unnecessary increase in damage. A defective product must be sent for repair or replacement securely packed and accompanied by a copy of the order confirmation.

Except where required by the Finnish Consumer Protection Act, the Seller is not liable for indirect loss caused by a product defect or delay in delivery.

9. Limitation of liability in certain circumstances

The Seller’s liability for poor product availability is always limited to cancellation of the sale and, where applicable, refund of payments made in advance. The Seller is not responsible for information displayed on product manufacturers’ websites. The Seller’s liability is always limited to direct loss unless the Seller can be shown to have acted negligently.

10. Customer register

The Seller may maintain a customer register. The customer register is confidential, and the Seller undertakes not to disclose customer information to parties other than those stated in the privacy notice.

11. Amendments to the online store terms

These terms may be amended unilaterally without prior notice. In the relationship between the Seller and the Customer, the contractual terms applicable to an order are those in force when the order was placed. New orders are always subject to the contractual terms in force at the relevant time and available on the Seller’s Website.

If the Customer has questions about an individual order or the interpretation or application of these terms, the Customer is advised to contact the Seller’s customer service using the contact details available on the Seller’s Website.

12. Governing law and dispute resolution

These sales terms are governed by Finnish law. If a dispute cannot be resolved through negotiations between the parties, a consumer buyer may refer the matter to the Finnish Consumer Disputes Board. If the dispute is resolved in court, proceedings must be brought before the district court of the Customer’s place of residence unless the Customer elects to bring proceedings before the district court of the Seller’s domicile. In transactions other than consumer sales, the Seller may also bring proceedings before the Helsinki District Court.
